The legislation was supported by former Fox News personalities Gretchen Carlson and Julie Roginsky, who appeared with lawmakers after the bill passed the House last month.

The bill applies only to situations before a dispute arises, not after, and does not cover other workplace misconduct such as age and race discrimination. The bill also would not apply to NDAs signed as part of settlements in s*xual harassment cases. Instead, the legislation covers the type of “coercive” NDAs that employees face as conditions of employment.

First, November. 16: A law that would limit employers’ use of non-disclosure agreements to silence victims of s*xual harassment was overwhelmingly passed by the House on Wednesday and will now go to President Joe Biden for signature.

The legislation is the next step in a law signed by Biden earlier this year that ended forced arbitration in such cases. The president is expected to sign the new bill.

The House voted 315-109 for the Speak Out Act. Former Fox News personalities Gretchen Carlson and Julie Roginsky have supported the legislation.

At a Capitol Hill press conference with lawmakers and hosted by Rep. Louis Frankel (D-FL), Carlson said, “When I finally got the courage to sue Roger Ailes and Fox News, it was really a It was a dark day when my team of lawyers told me that you really didn’t have a case. I said, well, what are you talking about? They said because of the silence clause that is in your contract.

She added, “So I signed this contract and I’m not alone. Millions of other Americans have signed similar contracts. Incredibly, that day, the choice had already been made for me. . And that’s what’s so crazy about these NDAs and forced arbitration is that you’re signing on the dotted line before anything actually happens to you. Filed a case.

Roginski said the legislation would help witnesses to s*xual harassment and “make the American workplace safer.”

He said the next step should be legislation to prevent NDAs on racial and gender discrimination as well as age discrimination. “Anything that is subject to discrimination and retaliation should not be bound by confidentiality,” he said. Carlson noted that at the state level, Washington, New Jersey and California have already passed bans on NDAs for all workplace issues, and they plan to introduce bans in New York in January.

Rep. Jerry Nadler (D-NY) also expressed hope that Congress will eventually pass a bill banning forced arbitration for broad workplace issues after passing a small piece of legislation this year.

On the House floor, Rep. Ken Buck (R-CO), another sponsor of the legislation, said, “If you’re raped, you can’t be imposed. This law gives us a choice. . We can protect workplace rapists, predators, perpetrators, or we can give voice to victims, survivors and the most vulnerable among us.”

Representative Jim Jordan (R-OH), however, called the bill “a massive federal overreach” because it regulates contract law that should be handled at the state level.
